Or What We Can Do For You Before You Sign Or Renew Your Modelling Contract


 

No this is not some article about a new emerging area of law or legal practice called Before Law.

It is more a legal lesson that we see learnt and experienced time and time again and would like to share with you out there and particularly to you aspiring fashion models that are about to your first modeling contract or are about to renew your modelling agreement.

 

Before Law is based on us wanting to see and talk to you before you take that important step of taking action in signing or renewing that modelling contract.

 

This is so you know what you are getting yourself into or us even being able to place you in a better bargaining or negotiating position. 

You see Before Law gives you some control over your legal matter.

Beforehand we as your lawyers can work with you to;

1. specifically customise your contract so it is not just some off the shelf shell contract handed out to everyone on a take it or leave it basis.

2. review the modelling contract to alert you to any pitfalls and make suggestions for changes to it.

Before Law costs a lot less than After Law which I haven’t talked about until now.

 

After Law is invariably when something hasn't gone as planned and we have to deal with whatever has eventuated without the benefit of having seen your contract before. It also goes without saying that After Law costs a lot lot more than Before Law.

Before Law means you get good legal advice before you make or commit to that important legal decision.

Property Law Update

 

Tree Disputes With Neighbours Or Your Council

 

They say approaching a neighbour to talk to them regarding a problem concerning both of you is one of the hardest things you can do.

This is especially so if it involves something contentious like an overhanging or encroaching tree onto your property and especially if it seems to affect you more than your neighbour.

Naturally most people want to maintain positive neighbourly relations with the people they live nearby.

Tree disputes between neighbours are governed in New South Wales by virtue of the Trees (Disputes Between Neighbours) Act 2006, a relatively new piece of legislation.

Tree disputes are now dealt with, if not resolved, in the NSW Land and Environment Court.

The flavour of the legislation and the philosophy of the Court are towards advocating for reasonable efforts to be made between neighbours firstly through negotiation and even mediation and if the matter cannot be resolved, through a practical, streamlined, case managed and timely process in the NSW Land and Environment Court. Urgent applications can be made in cases where risk of injury is imminent.

Clearly however a non-adversarial negotiation based approach whereby the parties retain some control over the outcome makes more sense than taking court action and causing irreparable harm to any goodwill that exists between the parties and leaving the outcome of the dispute to an independent third party. However if it does come to the latter, then you may need to consult a lawyer.

  • facilitating the process through the Court on your behalf for an order to remedy, restrain or prevent damage to property or injury to a person as a consequence of a tree on adjoining land. This could include having your neighbour prune or remove the offending tree, repair any damage caused by it or else pay compensation.
  • helping you enforce whatever the outcome may be.

                              Artist Gallery Consignment Agreements
                             
                            Why Artists and Art Galleries Need Them

 

·        Consignment is essentially about an artist giving their art to a gallery to sell on their behalf – this very process being enough to warrant such arrangement being properly documented.

·         Because a consignment agreement clearly states each party’s responsibilities and rights.

·         A clearly written consignment agreement will minimise uncertainty and conflict if a dispute arises.

·         Memory and recollection are poor substitutes for clear written documentation.

·         Prevention is better than cure.

·         A relatively small outlay now will hopefully prevent a larger loss later.

·         Having a consignment agreement and registering it with the Personal Property Securities Register (PPS) protects an artist’s interest in the event a gallery becomes insolvent.
